Terms of Service

1. Eligibility

You must be at least 13 years of age to use NoteTaker 1. By using our service you represent that you meet this requirement. The service is currently available only in India. Users accessing the service from outside India do so at their own risk and we make no representation that the service is appropriate or available in other locations.

2. Account Registration

• You may register using a valid Indian mobile number via OTP verification.
• You are responsible for maintaining the confidentiality of your account.
• You must provide accurate and complete information during registration.
• You are responsible for all activities that occur under your account.
• Notify us immediately at {{SUPPORT_EMAIL}} if you suspect unauthorised use of your account.

3. Subscription Plans and Pricing

NoteTaker 1 offers the following subscription plans:

• All paid plans include a 30-day free trial. No charge is made during the trial period.
• Prices are in Indian Rupees (INR) and inclusive of applicable taxes.
• Payments are processed securely by Razorpay. We do not store your payment credentials.
• Subscriptions auto-renew at the end of each billing cycle unless cancelled.
• You will receive an email reminder 7 days before your trial or subscription renews.
• We reserve the right to change pricing with 30 days' notice to active subscribers.

4. Cancellation and Refunds

Please refer to our Refund and Cancellation Policy for full details. In summary:

• You may cancel your subscription at any time from your account settings.
• Upon cancellation, you retain access until the end of the current billing period.
• Refunds are available within 7 days of initial payment for annual plans.
• No refunds are issued for monthly subscriptions already in progress.

5. Acceptable Use

You agree not to use NoteTaker 1 to:

• Violate any applicable Indian or international laws or regulations.
• Upload, store, or transmit content that is unlawful, harmful, defamatory, obscene, or infringing on third-party intellectual property rights.
• Attempt to gain unauthorised access to our systems or another user's account.
• Reverse engineer, decompile, or attempt to extract the source code of our application.
• Use automated tools, bots, or scrapers on our service.
• Resell or sublicense access to our service.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Your Content

• You retain full ownership of all notes, drawings, recordings, and other content you create in NoteTaker 1.
• You grant us a limited, non-exclusive licence to store and process your content solely to provide the service.
• We do not claim any intellectual property rights over your content.
• You are solely responsible for ensuring your content does not infringe third-party rights.
• Upon account deletion, your content is permanently deleted within 30 days.

7. Service Availability

• We aim for 99% uptime but do not guarantee uninterrupted availability.
• We may perform scheduled maintenance with advance notice where possible.
• We are not liable for losses resulting from service unavailability beyond our reasonable control.
• Features may be added, modified, or removed with reasonable notice to users.

8. Intellectual Property

All rights in NoteTaker 1's software, design, branding, and documentation are owned by or licensed to us. Nothing in these Terms grants you any right to use our trademarks, logos, or brand names without our prior written consent.

9. Disclaimer of Warranties

NoteTaker 1 is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, our total liability to you for any claim arising from or related to these Terms or your use of the service shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for any indirect, incidental, or consequential damages including loss of data, loss of revenue, or loss of profits.

11. Termination

We may suspend or terminate your account immediately if you breach these Terms, fail to pay subscription fees, or engage in fraudulent activity. Upon termination, your right to use the service ceases immediately. You may request export of your data prior to termination.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in India.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 15 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the revised Terms.
